Unauthorized discharges of dredged and fill material occurred to 2.28 acres of wetlands adjacent to the Green River in conjunction with Gasco's construction of a well pad and access roads. The violations were initially addresssed through a September 29, 2011, administrative order (AO) issued by EPA. Gasco then challenged the AO through an appeal under the Administrative Procedure Act and EPA filed counterclaims seeking civil penalties and restoration of the impacted wetlands. The consent decree resolves the violations.
