Respondent is the owner and operator of Phases 5 and 6 of the La Mer development located off of Ernston Road in Sayreville, NJ. The Respondent failed to comply with the New Jersey Department of Environmental Protection (NJDEP) General Permit for Stormwater Discharges associated with Construction Activity, including failure to install and/or properly implement and maintain stormwater Best Management Practice (BMPs) at Phases 5 and 6 of the Site. Stormwater discharges from the Site drain to Cheesequake Creek.
