Plaintiffs U.S. EPA and the Nevade Department of Environmental Protection (NDEP) have jointly entered into a Consent Decree with Newmont USA Limited (Newmont), resolving Newmont's alleged violations of the State's authorized hazardous waste program under Subtitle C of the Resource Conservation and Recovery Act (RCRA). Although Newmont disputed the allegations, it has conducted itself in good faith in its discussions with the Plaintiffs, and has implemented operational changes at its Facility, obviating the need for injunctive relief pertaining to the alleged violations. Newmont has agreed to pay a total civil penalty of $395,000, with each Plaintiff receiving half ($197,500).
