Summary

On May 16, 2014 EPA Region 1 signed a Consent Agreement and Final Order (“CAFO”) to resolve an administrative penalty case against the A.W. Chesterton Company (“Chesterton”), a Massachusetts Corporation which formulates, produces, packages, labels, distributes and sells industrial lubricants and fluid sealing systems, high performance protective coatings, and specialty industrial maintenance products. The CAFO requires Chesterton to pay a $65,000 monetary penalty to resolve violations of the Federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”), as alleged in a complaint Region 1 filed on September 27, 2013. The FIFRA claims relate to Chesterton’s failure to file FIFRA-required annual pesticide production reports by the regulatory deadline for its Groveland, Massachusetts facility over a five-year period. The complaint also alleges the company, which is registered with EPA as a pesticide production establishment, produced four different unregistered pesticidal machine coolant products at the Groveland facility. The company has since come into compliance with the facility’s annual pesticide production reporting requirements and is seeking to relabel the four products so that the labels no longer make pesticide claims regulated under FIFRA.
