This consent agreement and final order resolves violations of the requirements of the Lead-Based Paint Disclosure Rule, promulgated pursuant to Section 1018 of the Residential Lead-Based Paint Hazard Reduction Act of 1992. Donald Ciotola and Carol Simeone are landlords with rental properties in Rhode Island. In the complaint, EPA alleged they had failed provide their tenants with the required information and records regarding the presence of lead-based paint in the units before the tenants signed the lease. Following the inspection, Mr. Ciotola and Ms. Simeone have come into compliance with the Disclosure Rule and the Renovation, Repair, and Painting Rule. Mr. Ciotola and Ms. Simeone have agreed to pay a penalty of $13,900 to resolve the violations. This enforcement action is expected to encourage compliance in the regulated community with the Disclosure Rule and help protect prospective tenants from exposure to lead-based paint.
