Summary

The Consent Decree resolves the United States’ civil claims against Heritage for violations of the Clean Air Act and the Resource Conservation and Recovery Act at its Indianapolis, Indiana and Lemont, Illinois hazard waste treatment, storage and disposal facilities. Heritage violated the Clean Air Act and the national emission standard for hazardous air pollutants (NESHAPs) for benzene waste operations by failing to accurately determine its total annual benzene received, failing to properly develop and maintain records of its total annual benzene received, failing to submit required reports and failing to install equipment to control benzene emissions. Heritage violated RCRA and emissions control regulations relating to tanks containing hazardous waste at its Indianapolis facility by failing to install and operate control equipment, failing to determine initial maximum organic vapor pressure, failing to complete inspections, failing to maintain records of inspections and failing to secure and maintain proper controls on a hazardous waste container.
