PPA FOR UNIROYAL PLASTICS SITE WITH THE CITY OF MISHAWAKA, IN WOULD RESOLVE CERTAIN CLAIMS OF THE US UNDER SECTIONS 106 AND 107 OF CERCLA, AND CLAIMS BY THE STATE OF INDIANA UNDER CODE SECTIONS 12-25-4-1-13-25-4-27. THE PPA IS STRUCTURED IN PHASES, WITH THE CITY OF MISHAWAKA PROVIDING CERTAIN IMMEDIATE CONSIDERATION AND ENVIRONMENTAL BENEFITS UNDER A LEASE ARRANGEMENT, WHILE IT FURTHER EVALUATES ITS OPTION TO PURCHASE THE PROPERTY WITHIN A DEFINED TIMEFR AME. SHOULD THE CITY EXERCISE ITS OPTION, IT MUST PROVIDE FURTHER CONSIDERATION AND SUBSTANTIAL ADDITIONAL ENVIRON- MENTAL BENEFITS. THE PPA WOULD REQUIRE THE CITY TO PAY THE US $2500 WITHIN60 DAYS OF THE EFFECTIVE DATE FOR THE PPA AND $2500 IF THE CITY EXERCISES ITS OPTION TO PURCHASE THE PROPERTY. THE PPA WOULD ALSO REQUIRE THE CITY TO PERFORM CERTAIN WORK, SUCH AS ASBESTOS INVENTORY REPORT, ASBESTOS RE MOVAL, AND SITE SECURITY, AS DESCRIBED IN THE PPA. THE SITE IS NOT ON THE NPL, AND NO FURTHER RESPONSE ACTIVITIES AT THE SITE ARE ANTICIPATED.
