THE RESPONDENT HAD A RELEASE OF 500 POUNDS OF CHLORINE INTO THE ATMOSPHERE, ON JULY 20, 1998. THE RELEASE CAUSED THE EVACULATION OF NAVY PIER. TEN PEOPLE WERE SENT TO LOCAL HOSPITALS AS PRECAUTIONARY MEASURES. THE RESPONDENT NOTIFIED THE NATIONAL RESPONSE CENTER ON JULY 22, 1998, ALMOST TWO DAYS AFTER THE INCIDENT. THIS RELEASE IS 50 TIMES THE REPORTABLE QUANTITY. THE STATE EMERGENCY RESPONSE COMMISSION IS PURSUING THE EMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW ACT VIOLATIONS. ON 9/14/99, USEPA SENT TO THE RESPONDENT A PRE-FILING NOTICE TO ADVISE THE RESPONDENT OF THE AGENCY'S INTENT TO FILE AN ADMINISTRATIVE COMPLAINT. THE AGENCY AND THE RESPONDENT MET ON 9/29/99, TO DISCUSS THIS MATTER AND SETTLEMENT. THE AGENCY FILED THE JOINT ADMINISTRATIVE COMPLAINT AND CONSENT AGREEMENT AND FINAL ORDER AS ALLOWED UNDER ADMINISTRATIVE PART 22 RULES.
