Based on a State of Wisconsin inspection, EPA cited L.G. Kienast for notice and work practice violations of the asbestos NESHAP. These violations are associated with the demolition of the H.D. Hudson Building in Oshkosh, Wisconsin. The matter went to administrative hearing. Judge McGuire ruled in favor of EPA for all counts but one, and assessed a penalty in the amount of $35,000. Subsequent to the judge's decision, the Environmental Appeals Board ordered Sua Sponte that it will review the assessed penalty.
