This settlement involves 10 facilities in eight states which includes the 2 facilities (Chicago, IL. and Cleveland, OH.) in Region 5. Penalties are required in the amount of $69,000 for Region 5 (Federal and State required) and $300,000 for the global case. The settlement terms created an innovative sampling plan and training plan that will assure completely accurate benzene reporting, calculating, and compliance. The three year sampling plan is based on the amount of benzene wastes received in the prior year so that the sampling requirements evolve as the business fluctuates.
