## Summary

IN JULY 1999, EPA PERFORMED A REMOVAL ACTION AT THE SITE.    THE REMOVAL INCLUDED STABILIZING AND DISPOSING OF APPROXI-   MATELY 3,670 TONS OF SOIL AND EXCAVATED CONCRETE CONTAMI-    NATED WITH LEAD ABOVE 1,000 PARTS PER MILLION.  PURSUANT TO  A JOINT POWERS AGREEMENT ENACTED IN JULY 1999 BETWEEN        HENNEPIN COUNTY AND THE MINNESOTA POLLUTION CONTROL AGENCY   ( MPCA ), HENNEPIN COUNTY CONDUCTED AN ADDITIONAL CLEANUP OF SOIL AT THE SITE.  CONTAMINANTS REMAINING IN THE SOIL ARE AT LEVELS THAT ALLOW CONSTRUCTION OF A TRANSIT CONTROL CENTER.  THE SETTLING RESPONDENT, METROPOLITAN COUNCIL, AGREES TO PAY TO EPA THE SUME OF $1,000.00, WITHIN 30 DAYS OF THE EFFECT-  IVE DATE OF AGREEMENT.  IF THE SETTLING RESPONDENT FAIL TO   COMPLY WITH THE TERMS OF THIS AGREEMENT, IT SHALL BE LIABLE  FOR ALL LITIGATION AND OTHER ENFORCEMENT COSTS INCURRED BY   THE UNITED STATES TO ENFORCE THIS AGREEMENT OR OTHERWISE     OBTAIN COMPLIANCE.
