REMOVAL DONE AT THE SITE BY EPA. JAY FREUD OWNS THE SITE PROPERTY. HE FILED FOR BANKRUPTCY AND THE BANKRUPTCY TRUSTEE ENTERED INTO AN AGREEMENT IN PRINCIPLE WITH EPA, WHEREBY UPON THE SALE OF THE PROPERTY EPA WOULD RECEIVE 50% OF THE NET PROCEEDS. EPA AND THE TRUSTEE ARE IN THE PROCESS OF ENTERING INTO A SETTLEMENT AGREEMENT, WHICH WOULD MEMORIALIZE THE AGREEMENT IN PRINCIPLE. THE PROPERTY WAS SOLD FOR $150,000 AND THE TRUSTEE IS HOLDING THE PROCEEDS PENDING THE EXECUTION AND ENTRY OF THE SETTLEMENT AGREEMENT. EPA IS EXPECTED TO RECEIVE APPROXIMATELY $39,000 FROM THE PROCEEDS OF THE SALE OF THE PROPERTY.
