On November 26, 2013, Region 1 filed a CAFO settling claims for penalties against Harbor Fuel Oil Corporation of Nantucket, Massachusetts for its violation of the Clean Water Act and the Oil Pollution Prevention Regulations at 40 C.F.R. Part 112. EPA became aware of the companyÂs violations when it failed to successfully complete a Government-Initiated Unannounced Exercise (GIUE) at its fuel storage and distribution facility. The facilityÂs overall Âunsuccessful rating for the exercise led EPA to determine that the company could not properly carry out the facilityÂs facility response plan (FRP) in the case of an oil spill and that its personnel were not adequately trained to respond to an oil spill in violation of FRP requirements. The company will pay a $14,000 penalty and implement a Supplemental Environmental Project worth at least $ 37,940.
