On December 18,2012, EPA Region 6 issued a Consent Agreement and Final Order (CA/FO) under its authority pursuant to The Resource Conservaton and Recovery Act (RCRA) and Clean Air Act (CAA) to Exide Technologies, Inc., located in Frisco, Texas. The CA/FO was issued in response to violations of: RCRA unpermitted storage, failure to make hazardous waste determinations, and failure to meet operating standards for a permitted unit, and, CAA failure to control fugitive dust emissions, failure to install enclosure hoods, and failure to maintain required records. The CA/FO requires Exide to pay a penalty of $225,000, provide copies of all work orders for door replacement and repairs to the Raw Materials Storage Building, and delineate any lead contamination in the area of the Flood Wall and Stewart Creek, and submit a closure plan for the area to the Texas Commission for Environmental Quality.
