Summary

This Settlement Agreement concerns the Miller Salvage site (Site) located at 1617 Laparell Road in Latham, Pike County, Ohio. In response to the release or threatened release of hazardous substances at or from the Site, EPA undertook response actions at the Site pursuant to Section 104 of CERCLA, which included the following: Coordinated site investigation and file review with Ohio EPA; conducted site assessment activities; and conducted oversight of voluntary cleanup action by Mill's Pride (known as Masco Cabinetry Middlefield LLC). Prior to December 4, 2007, Mill's Pride voluntarily performed removal actions at the Site. On December 4, 2007, EPA entered into an Administrative Settlement Agreement and Order on Consent for Removal Action (ASAOC) with Mill's Pride. The ASAOC required Mill's Pride to remove all sawdust and waste material that was contributing to off-site contamination, maintain a leachate collection system, grade soils to prevent run-off water from being collected by the leachate pond, close the smaller on-site leachate pond, and remove leachate and sludge from the large collection pond. The ASAOC also required that Mill's Pride reimburse EPA's oversight costs for the removal action. The December 4, 2007 ASAOC did not address the response costs incurred by EPA prior to the effective date of the agreement. In performing response actions, EPA has incurred response costs at, or in connection with, the Site that were not covered by the 2007 Order.
