On September 18, 2013, Region 10 settled with Targa Sound Terminal LLC for violations of Emergency Planning Community Right to Know Act (EPCRA) Section 312. Between 2008 and 2011, the company failed to file inventory reports on fuel oil, ethanol, diesel, asphalt, and propane. EPCRA requires companies to report more than 10,000 pounds of on-site storage for each of these chemicals. The company stored between 750,000 pounds and up to 200 million pounds of each chemical without reporting to state and federal agencies or the Tacoma Fire Department as required by law. The company has agreed to pay a penalty of $13,435. In addition, the company has agreed to spend over $50,000 on projects that will improve emergency response capabilities in the area. The company will purchase and donate drum and leak seal kits, spill neutralizers and a hazardous materials identification processor for the Pierce County Hazardous Incident Team.
