Summary

This case addresses violations of the Clean Air Act (CAA) by BSP LLC ( BSP), located in Jennings, Florida. On September 27, 2012 BSP imported 1,400 partially complete nonroad gasoline engines ( the subject engines ) into the United States. On October 12, 2012, BSP LLC obtained a competition exemption from EPA to cover future importations of engines identical to the subject engines to be used in competition go-karts. Importation of NRSI engines that are not covered by a valid EPA issued certificate of conformity nor an approved exemption violates 40 C.F.R. § 1068.101(a)(5). As a result of this enforcement matter, BSP has agreed to 1) obtain EPA’s approval for a competition exemption for the engine model; 2)install permanent EPA-approved competition-only labels in readily visible place on Subject Engines; and 3) submit a report to EPA documenting the installation of the competition-only labels on each Subject Engine. As part of this settlement, BSP also paid a $7,000 civil penalty to the United States Treasury.
