This is a civil administrative penalty action instituted against Thermal Energy Development Partnership, L.P. pursuant to Section 113(d) of the Clean Air Act (“CAA” or the “Act”), 42 U.S.C. § 7413(d), for alleged violations of Section 111 of the Act, 42 U.S.C. § 7411, Standards for Performance for New Stationary Sources (“NSPS”) and its implementing federal regulati6ns at 40 C.F.R. Part 60, Subpart Db — “Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units (“Subpart Db”) and for alleged violations of a federally approved implementation plan under Section ll0 of the CAA,42U.S.C. § 7410. The respondent agrees to pay a $145,000 penalty.
