This Notice of Determination was filed in response to violations to CAA, CWA 311/SPCC and EPCRA 311/312 which were voluntarily disclosed by the Rose-Hulman Institute of Technology on 1/31/2011. Based on the information submitted, the EPA has determined that Rose-Hulman has met all of the criteria set forth in the Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations (65 FedReg 19618 (April 11, 2000)) as well as the conditions of the Audit Policy Agreement by and between the Independent Colleges of Indiana, the Participating Institutions and the US EPA, Region 5 . As a result, the EPA has mitigated the civil penalty by 100%.
