On June 24, 2011, EPA issued a Notice and Finding of Violation to Gopher Resource Corporation, Eagan, Minnesota, for alleged violations of the Minnesota State Implementation Plan and Title V of the Clean Air Act. EPA is now entering into an Administrative Compliance Order (ACO) and a Consent Agreement and Final Order (CAFO) to resolve the alleged violations.
The ACO requires Gopher to use its spray dry absorber, which is a control device for sulfur dioxide (SO2), to achieve an emission rate of 500 pounds of SO2 per hour. Gopher's current emission limit is 530 pounds of SO2 per hour.
