In entering into this Settlement Agreement, the objectives of the Parties are: (a) to determine the nature and extent of contamination and any threat to the public health, welfare, or the environment caused by the release or threatened release of hazardous substances, pollutants or contaminants at or from OU4 by conducting an engineering evaluation as more specifically set forth in the EE/CA Work Plan for OU4 attached as Appendix C to this Settlement Agreement;
(b) to identify and evaluate alternatives to prevent, mitigate or otherwise respond to or remedy any release or threatened release of hazardous substances, pollutants or contaminants at or from OU4 by conducting a cost analysis as more specifically set forth in the EE/CA Work Plan; (c) to conduct all actions necessary to implement the Removal Action to be selected in the Action Memorandum for 004, in accordance with the Removal Action Work Plan for OU4 to be
developed hereunder; (d) to assess injuries to natural resources and identify and evaluate opportunities for coordinating or integrating implementation of natural resource restoration with the Removal Action to be selected for OU4; and (e) to recover response and assessment costs incurred by the Environmental Agencies with respect to this Settlement Agreement.
