On February 5, 2013, EPA Region 6 issued a Cease and Desist Administrative Order (AO) under its authority pursuant to Sections 308 and 309(a) of the Clean Water Act to the Harper Valley Home Owners Association, located in Farmington, NM. The AO was issued in response to violations of the facility discharging without an NPDES permit. The AO requires Harper Valley Home Owners Association to: 1) cease discharges into the San Juan River; 2) submit certification to the EPA that the facility has ceased discharging to waters of the U.S.; and 3) submit a plan to EPA detailing short and long-term wastewater disposal plans. Harper Valley Home Owners Association must respond to EPA Region 6 within seven days from the effective date of the AO.
