This case addresses violations of the Clean Air Act (CAA) by El Sol Trading Inc., d.b.a. Motobravo, Inc. (El Sol). El Sol is a private California company that imports, manufactures, and sells highway motorcycles, recreational motorcycles, and other vehicles. Between March 2009 and November, 2012 EPA conduced multiple inspections of El Sol's vehicles. EPA found 592 highway motorcycles and all-terrain vehicles (ATV's) which failed to comply with section 203(a) and/or 213(d) of the CAA. The vehicles either a) not covered by an EPA-issued certificate of conformiy (COC), b) had catalytic converters that failed to meet the conditions of the COC or c) bore labels which stated that they were manufactured in 2009 when they were actually manufactured in 2011.
As part of the settlement with EPA, El Sol has agreed to pay a $60,000 civil penalty to the US Treasury.
