On April 25, 2013, EPA Region 6 issued an Administrative Complaint, Compliance Order and Notice of Opportunity for a Hearing under its authority pursuant to Section n3008(a) of the Resource Conservation and Recovery Act (RCRA) to TM Deer Park Services Limited Partnership. The Complaint was issued in response to violations of hazardous waste management requirements and requires TM Deer Park Services Limited Partnership to comply with certain hazardous waste management requirements by either ceasing operation of an unpermitted hazardous waste containment building, or by operating the containment building for a limited period in compliance with specific conditions while it obtains the required permit authorization. The Complaint also assesses an administrative civil penalty of $517,944.
