On May 23, 2013, EPA and the Respondent entered into an Administrative Order on Consent which relates to the Respondent's construction and maintenance of a new nitrogen gas pipeline (Pipeline) over a portion of the LCP Chemicals, Inc. Superfund Site, in a manner which causes minimal interference with response actions which occur at the site. The Respondent currently operates a nitrogen gas pipeline on an easement it owns on the site.
In accordance with the terms of the proposed AOC, the Respondent will be required to allow EPA full access to its easement and will pay EPAÂs costs related to oversight of the work conducted by the Respondent on its Pipeline. The Respondent also acknowledges that EPA may require relocation of the Pipeline during implementation of the response action selected by EPA.
Issuance of this AOC will ensure continued access to the easement and facilitate coordination between EPA, the Respondent and ISP Environmental Services, the party conducting the RI/FS on the site.
