On August 5, 2013, Region 10 issued a Compliance Order on Consent that resolves an NPDES violation by J.R. Simplot Company. On December 30, 2012, the company had an unauthorized discharge of wastewater to the Boise River. The company does not have an NPDES permit and normally land applies the wastewater. The Compliance Order on Consent requires J.R. Simplot Company to monitor the berm intended to prevent such discharges into the Boise River and to repair it when necessary.
