On April 24, 2013, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 301 of the Clean Water Act to MCA Petroleum Corporation (Respondent), located in Bastrop County, Texas. The AO was issued in response to an unauthorized discharge of produced wastewater to a water of the U.S. The AO requires Respondent to cease all discharge of produced water from their facility. The Order allows that if Respondent is eligible for National Pollutant Discharge Elimination System (NPDES) coverage and they submit a permit application the Order may be revised. Respondent must respond to EPA within sixty (60) days of receipt of the AO.
