On June 18, 2013, EPA Region 6 issued a Complaint and Consent Agreement and Final Order (CAFO) under its authority pursuant to the Clean Air Act to company. The CAFO was issued in response to violations of: 40 CFR Part 63 Supart G (National Emissions Standards for Organic Hazardous Air Pollutants from Sythetic Organi Chemical Manufacturing Industry. The CAFO requires company to pay an assessed penalty of $70,000 within 30 days of the effective date of the CAFO. Additionally, the CAFO requires Georgia-Pacific to acquire and implement an electronic system for tracking and recording its actions to comply with applicable leak detection and repair regulations and to submit to Texas Commission on Environmental Quality (TCEQ) and EPA an updated Notice of Compliance Status pursuant to 40 C.F.R. § 63.152 within 365 days of the CAFO effective date.
