RESPONDENT ADMITS THAT FROM THE DATE OF THE EPA INSPECTION ON FEBRUARY 17, 2011, UNTIL MARCH 8, 2013, IT FAILED TO PREPARE AND IMPLEMENT AN SPCC PLAN FRO THE PREMIER PAVING INC. ASPHALT PLANT IN ACCORDANCE WITH 40 CFR 112.7 AND 112.8.
On February 17, 2011, the EPA inspected two facilities owned by Premier Paving, Inc.: 1) the Asphalt Plant; and
2) the Office/Maintenance Facility. Both facilities were out of compliance with the Spill Prevention, Control and
Countermeasure (SPCC) regulations, with both SPCC plan and implementation violations found. The
Office/Maintenance Facility came into compliance July 12, 2012. The Asphalt Plant came into compliance on
March 8, 2013.
