Region 5 executed a Consent Agreement and Final Order (CAFO) under Sections 113(d) of the Clean Air Act (CAA) with HA International, LLC (HAI). On August 23, 2012, Region 5 issued a Notice of Violation, alleging that HAIÂs facility in Oregon, Illinois was violating the Illinois State Implementation PlanÂs (SIP) prohibitions on air pollution on emitting more than 8 lbs/hr of organic material, and provisions that prohibit the emissions of any air contaminant that may cause air pollution in Illinois. The CAFO requires HAI to pay a penalty of $100,000 and spend an additional $100,000 on Supplemental Environmental Projects (SEPs). The SEPs include indoor air quality and energy efficiency upgrades to two Oregon-area schools and two projects at HAIÂs Oregon facility to reduce emissions of the resin-coated sand product from loading operations and its baghouses.
