Respondent is a PRP at the Mercury Refining Superfund Site that refused to settle with EPA under any of the previous de minimis settlements or the recent judicial consent decree. After referral to the Department of Justice, the company agreed to pay to cover its share of costs at the Site, including a premium and also as a penalty for its failure to respond to the 104e letter.
