Consent Decree settlement filed in Federal District Court ? Massachusetts involving JSB Industries, Inc. and affiliated owners/operators of JSB?s baking and distribution facilities in Chelsea and Lawrence, MA. Decree will resolve claims that JSB violated chemical accident prevention provisions of the CAA Sec. 112(r)(1) (known as the ?general duty clause? requirements), chemical release notification requirements under CERCLA Section 103, and chemical inventory reporting requirements under EPCRA Sections 311 and 312. Most violations stem from a 2009 release of anhydrous ammonia from a refrigeration system then in use by JSB at the Chelsea plant. Settlement requires payment of a $156,000 monetary penalty and about $119,000 to implement a supplemental environmental project (SEP) intended to enhance chemical emergency preparedness and response capabilities in the Chelsea and Lawrence communities.
