Respondent found to be in violation of the Clean Air Act Section 112(r)(1) General Duty Clause (GDC) requirements in September 2011. They violated GDC requirements by failing to ensure facility safety and prevent releases of ammonia from the cold storage operations in their San Juan facility. EPA ordered Respondent to take necessary steps to identify hazards which may result from accidental releases of regulated substances and other extremely hazardous substances from the facility, to design and maintain a safe facility by taking steps necessary to prevent releases, and minimize the consequences of accidental releases.
