The Respondent owns and operates the sand and gravel facility in Bloomingburg, NY. Respondent discharges stormwater associated with industrial activity to a tributary of Shawangunk Kill and failed to obtain coverage under the New York State Department of Environmental Conservation (NYSDEC) State Pollution Discharge Elimination System (SPDES) Multi-Sector General permit for Stormwater Discharges Associated with Industrial Activity (MSGP) or an individual SPDES permit. The Administrative Compliance Order requires Respondent to gain permit coverage or provide documentation demonstrating that stormwater from both active and inactive portions of the site is contained and discharges solely to groundwater in up to a 100 year, 24-hour storm event (Zero Discharge).
