This case addresses violations of the Clean Air Act (CAA) by JKY Investing ( JKY ), operating out of Fontana, California. On January 16, 2013, JKY imported 2,107 non-road spark-ignition engines that are not covered by a certificate of conformity and which therefore are in violation of the Clean Air Act. sections 203(a)(l) and 213(d) (42 U.S.C. 7522(a)(l) and 7547(d)), and Nonroad regulations at 40 C.F.R. sections 1068.10l(a)(l) and (b)(5).
As part of the settlement with EPA, JKY paid a $15,000 civil penalty and agreed to export the generators outside of the United States, Mexico or Canada.
