Respondent sold and/or distributed ÂCatchmaster Giant Fly Trap and the ÂCatchmaster Bug and Fly Clear Window Trap, both are pesticidal devices. These devices were manufactured in China and imported into the United States. The packaging of the ÂCatchmaster Giant Fly Trap displayed a New York State Establishment registration number instead of the registration number of the establishment in which it was actually produced (China). Thus, the ÂCatchmaster Giant Fly Trap was misbranded. Additionally, the Respondent failed to submit a Notice of Arrival of Pesticides and Devices Form to the EPA prior to the importation of the ÂCatchmaster Bug and Fly Clear Window Trap. Under FIFRA, a person may not distribute or sell misbranded pesticides. In addition, the failure of any Âregistrant, wholesaler, dealer, retailer, or other distributor to file reports required by FIFRA is unlawful. On April 17, 2012, duly authorized representatives of EPA conducted an inspection of the facility and found that the ÂCatchmaster Giant Fly Trap packaging had been brought into compliance with FIFRA requirements.
