Respondent discharged dredged or fill material into Sheep Creek and its adjacent wetlands (86 sites over 1.66 miles) near Saguache, Colorado, without a permit, in violation of section 301(a) of the CWA, 33 U.S.C. 1311 (a), which prohibits the discharge of a pollutant unless authorized by a permit issued under section 404 of the CWA, 33 U.S.C. 1344. A separate enforcement action (AOC) will be issued to Respondent to resolve the injunctive relief.
