WMWI owns and operates a solid waste landfill in Wisconsin that is the subject of this
lodging. The Metro Recycling & Disposal Facility (Metro RDF) landfill is located in Franklin,
Wisconsin. WMWI does not have a license to treat, store or dispose of hazardous waste at the Metro RDF landfill. From at least March 2005 to November 2009, WMWI accepted untreated hazardous electric arc furnace
(EAF) dust from Maynard Steel Casting Company (Maynard Steel) in Milwaukee, Wisconsin for
disposal at Metro RDF. Analytical results of samples collected by EPA and Maynard Steel show that the dust from the
EAFs exhibits the characteristic of toxicity for chromium. The levels of chromium in Maynard
Steel's EAF dust are typically five times or more than the regulatory level for chromium. Based
on the sampling results and responses to EPA information requests provided by WMWI and
Maynard Steel, EPA has found that WMWI is in violation of various requirements of the RCRA
and its implementing regulations at the Metro RDF landfill. WMWI has agreed to sample leachate and groundwater around that portion of the landfill where the EAF dust was placed and submit the results to EPA.
