On September 2, 2014, Region 10 filed a consent agreement and final order with Pacific Ethanol Magic Valley, LLC (Pacific Ethanol), a corn based ethanol production facility located in Burley, Idaho, to address violations of the Clean Air Act (CAA) � 112(r) risk management program rules. The Region alleged that Pacific Ethanol failed to comply with several risk management program requirements that apply to its use of aqueous ammonia and pentane. The violations have been corrected and the company agreed to pay a penalty of $83,497.
