Respondent, King's Primo Quality Construction, Inc. owned or operated a construction site located in Farmington, San Juan County, New Mexico. Respondent did not submit a Notice of Intent (NOI) for permit coverage for its activities at the facility, and was not covered by an NPDES Permit at the relevant times for the relevant activities. Respondent failed to develop and implement a storm water pollution prevention plan for the facility and failed to obtain Construction General Permit coverage under EPA NPDES Permit No. NMR12000.
