Summary

On June 20, 2014, Region 10 referred violations of the Clean Air Act (CAA) regulations addressing the management of ozone depleting substances by Trader Joe's Company to the Department of Justice. Trader Joe's operates a network of grocery stores that use ozone depleting substances in its commercial refrigeration appliances. In negotiations with EPA and DOJ, Trader Joe?s has agreed in principle to pay a civil penalty and implement injunctive relief as part of a nationwide settlement (lead by Region 9) encompassing approximately 413 stores located in all EPA Regions, including the 34 stores located in Idaho, Oregon and Washington. The types of violations include: (1) failure to repair an ODS leak exceeding an annual rate of 35% within 30 days of discovery; (2) failure to prepare and implement a one-year retrofit or retirement plan for the appliance within 30 days of discovery of a leak; and (3) failure to keep and maintain adequate refrigerant service records.
