Vernon Feeders, L.L.C. and Smith Investment Properties, L.L.C., Respondents owned and operated a feedlot, located at 6725 U.S. Highway 287 East Vernon, Wilbarger County, Texas. The facility was inspected on several occasions and was observed discharging storm water mixed with manure directly into Paradise Creek which is a waters of the United States . Also the facility failed to comply with the stipulations of Administrative Order Docket Number CWA-06-2008-2022. On October 30, 2014, a deed restriction was placed on this property to prohibit a beef feedlot operation without a permit.
