On September 8, 2014, Region 10 filed a consent agreement and final order that resolves RCRA hazardous waste violations at the Flint Hills Refining Alaska (Flint Hills) facility in North Pole, Alaska. The company failed to make a determination that spent groundwater pre-filters generated on site contained iron sulfide and were an ignitable and reactive hazardous waste. EPA alleged that Flint Hills stored hazardous waste at the facility without obtaining a permit or complying with conditions applicable to hazardous waste generators. Flint Hills now manages the spent groundwater pre-filters as hazardous waste. The company agreed to pay a penalty of $80,000.
