The Respondent is a permitted MS4 located in Suffolk County, NY. An MS4 Audit was conducted by EPA from May 22 through May 24, 2012 and identified that the Town was not complying with certain terms and conditions of the NYSDEC MS4 General Permit. Permit violations include failure to: develop and implement an adequate SWMP; fully develop and implement a construction and post-construction site stormwater program; submit annual reports by June 1 of the respective reporting year; include justification for changes made to measurable goals in the annual report; develop and implement an IDDE program; and develop and implement a pollution prevention and good housekeeping for municipal operations program. The Respondent opted to pay the penalty in full.
