On September 9, 2014, EPA filed an Expedited Settlement Agreement and Final Order (CAFO) with Holman Brothers Painting, located in Elida, Ohio. The CAFO commences and concludes a proceeding identifying an alleged violation of Section 402 of the Toxic Substances Control Act (TSCA), 15 U.S.C. 2682, and the Renovation, Repair and Painting (RRP) Rule at 40 C.F.R. Part 745, Subpart E. The CAFO alleges that Respondent failed to comply with the firm certification requirement to conduct renovation, repair, and painting activities in target housing and child-occupied facilities.
EPA and Respondent agreed to settle this matter for a civil penalty of $200 for the alleged violation, consistent with the May 29, 2012, �Lead-based Paint Expedited Settlement Agreement Pilot Program.� Respondent certified that it is now in compliance with Section 402 of TSCA and 40 CFR Part 745.
