MERECO failed to apply for a permit pursuant to Rhode Island Air Pollution Control Regulation 9 ( Reg 9 ) and to submit to EPA a Notification of Compliance Status ( NOCS ) under 40 C.F.R. Part 63,Subpart VVVVVV. MERECO will pay a penalty of $60,000 to EPA, apply for a Reg 9 permit, submit to EPA a NOCS, and undertake a number of compliance mesures in accordance with Subpart VVVVVV and Reg 9.
