This is a judicial action against Gibson Wine Company (Respondent) for failure to identify hazards associated with its ammonia refrigeration processes, design and maintain a safe facility, and mitigate accidental releases in violation of the General Duty Clause ( GDC ) of the Clean Air Act ( CAA ), 42 U.S.C. 7412(r)(l). Also, failure to promptly notify the National Response Center ( NRC ) and CalEPA of a release of a hazardous substance (anhydrous ammonia) above the applicable Reportable Quantity ( RQ ) in violation of CERCLA Section 103 and EPCRA Section 304, respectively.
