Wildcat Mountain resort is a ski resort operating typically from the end of November to the beginning of April. Summer activities include operation of some lifts for sightseeing and use of the zip line. At the time the inspection the resort was open for skiing. The facility has above ground storage capacity of 44,800 gallons for oil products. In the event of a spill there is a probability of oil being discharged to a nearby unnamed stream which drains to the Peabody River.
On February 27, 2014 the Region conducted a SPCC inspection at Wildcat Ski Resort facility and although the facility stores oil in amounts above the thresholds requiring the preparation and implementation of a SPCC plan under 40 C.F.R. Part 112, they failed to maintain an up-to-date SPCC Plan. Because of the size of the facility and other factors, EPA is utilizing the ESA enforcement tool.
