On March 7, 2011, 3M submitted to EPA an applicability determination request to determine if the calciners and/or dryers at its Abrasives System Division were subject to NSPS Subpart UUU. 3M concurrently disclosed to EPA potential violations of NSPS Subpart UUU relating to the same calciners and/or dryers at the Abrasives System Division in the applicability determination request. On April 5, 2011, EPA issued 3M an applicability determination, finding that the emission units at the Abrasives System Division are subject to NSPS Subpart UUU. On September 20, 2011, EPA issued a Notice and Finding of Violation (NOV/FOV) to 3M for violations of NSPS Subpart UUU, its Title V Permit and the MN SIP at the Abrasives System Division. On July 14, 2011, 3M disclosed to EPA potential violations of NSPS Subpart UUU relating to the calciners and/or dryers at the TSS Division. On March 27, 2012, EPA issued a NOV/FOV to 3M for violations of NSPS Subpart UUU, its Title V Permit and the MN SIP at the TSS Division. 3M has submitted all notifications, demonstrated compliance with applicable emission limits, began monitoring and recordkeeping requirements under NSPS Subpart UUU at both the Abrasives System Division and TSS Division.
