.On September 25, 2014, EPA issued a Consent Agreement and Final Order (CAFO) to resolve violations of the Resource Conservation and Recovery Act, by History Wood, LLC, located at two sites in Odell, Illinois. EPAÂs allegations were based on an Illinois Environmental Protection Agency inspection on September 1, 2011, and History WoodÂs response to an EPA Pre-Filing Notice and Opportunity to Confer Letter. History Wood failed to conduct hazardous waste determinations from its operations, including solvents, sludge, paint chips, dust, and unused product; and failed to properly treat or dispose of hazardous waste. Although EPA initially proposed an administrative civil penalty of $800,796, it subsequently conducted an inability to pay determination, and for the purposes of settlement agreed to a reduced penalty of $1,000. The CAFO also included a requirement to complete closure in accordance with its IEPA approved closure plan at both locations by October 5, 2014.
